Terms
EARTH terms of service
Updated: 2026-10-25
Welcome to the EARTH human history simulator (the "service"), operated by 簡勝烽 ("we"). These terms are published before purchases for your review. Purchasing points or using paid features means you have read, understood and agreed to these terms, the refund policy and privacy policy.
1. The service
- A human civilization simulation runs on a server and is streamed on YouTube. Its people, families, events and development are computer simulations, not historical facts or predictions.
- Viewers may watch and join chat for free, or buy points here to draw history intervention cards that affect the simulation.
- YouTube provides the stream. Its terms apply when you watch.
2. Accounts
- Purchases and draws require an EARTH account. Provide an accurate contact email and protect your sign-in method. Accounts are personal and cannot be lent, transferred or sold.
- Report unauthorized use immediately. We will suspend paid features for that account and help investigate.
3. Points
- Paid and bonus points are accounted for separately. Paid points follow the purchased package, without a fixed currency exchange rate. Bonus points are gifts with no cash value.
- Contents and prices follow the points page. New packages are priced in USD; old orders retain their original currency and price. Points are credited after the server verifies payment.
- Points do not expire.
- Bonus points are spent before paid points.
- Points are for this service only and cannot be transferred, traded or exchanged for cash or physical goods.
- Refunds follow the refund policy, covering 7-day withdrawals, termination, shutdown and minors.
4. Intervention cards: chance-based products
- This is a chance-based product. Purchase or participation does not guarantee any specific item.
- Each draw costs 30 points. The odds page discloses probabilities, guarantees and limited quantities. The draw page shows the actual current pool and card odds. There is currently no guarantee mechanism or limited-edition card.
- Server-side randomness follows the published odds. Results are not rerolled or replaced based on effect strength. Pool-change handling follows the published rules.
- Cards enter your hand, up to 200 cards, and expire after 7 real days without a refund. You choose when and which settlement to play at. Rejected plays keep the card. Played cards immediately affect the world according to their descriptions; calamities create finite local environmental hazards whose effects depend on actual exposure and body condition over simulation time, and may cause death or extinction. Subsequent development follows simulation rules, with no guaranteed outcome.
- Broadcasts present cards in queue order. Estimated times may be delayed by major events. Your chosen display name appears on the stream and site; do not use real names, another person's name, illegal, offensive or advertising content.
- Cards are one-time service effects without property value and cannot be transferred, traded or exchanged for money or goods.
- Card or probability changes are announced in advance with a new catalog version. Submitted draws follow the version at submission. Draw records remain until at least 180 days after the activity ends; you may request your records by email.
- Before paid draws, you confirm that a draw supplies digital content without a tangible medium, completing delivery; spent points do not qualify for 7-day withdrawal.
5. Minors
- Users under 18 must have a legal representative read and agree to these terms before purchasing.
- We may limit monthly purchases by minors. Representatives may request unused paid points bought without consent under the refund policy.
6. Prohibited conduct
You must not:
- Use stolen cards, another person's payment method or unlawful means to purchase.
- Exploit bugs, automation or abnormal methods to obtain points/cards or influence random results.
- Trade, rent or transfer accounts, points or cards, or use them for gambling or other property transactions.
- Use illegal, hateful, harassing, sexual, impersonating or advertising content in names or chat.
- Disrupt or attack servers, networks or broadcasts.
Depending on severity, we may remove names or suspend/terminate paid features. Legitimate unused paid points still follow the refund policy, except points verified as unlawfully obtained. We do not secretly confiscate lawful paid points.
7. Changes, interruptions and shutdown
- Maintenance, updates or force majeure may interrupt service. Planned maintenance is announced on the site or channel.
- For interruptions attributable to us, affected charged points are returned or reasonable compensation provided when a return is impossible.
- A shutdown is announced at least 30 days ahead, with notice and unused-paid-point refunds under the refund policy.
- Changes to terms and their effective dates are published. Adverse changes are also emailed to users with purchase records. You may terminate and request unused paid points if you disagree.
8. Intellectual property
Programs, images, artwork, text and simulation content belong to us or lawful licensors. You may share stream images and screenshots for personal, noncommercial use with attribution. Other uses need prior written consent.
9. Liability
- We use current technology and reasonable efforts to maintain service, without guaranteeing uninterrupted or error-free operation.
- We help investigate third-party failures, including YouTube, ECPay or network providers.
- These terms do not exclude liability for intent or gross negligence, or your rights under consumer protection and other laws.
10. Notices and contact
We notify you on this site or by your supplied email. Send requests, notices and complaints to hero870802@gmail.com. We respond to complaints within 15 days.
11. Governing law and jurisdiction
Republic of China (Taiwan) law applies. Both parties first seek a good-faith resolution. If litigation is needed, the district court at the consumer's residence has first-instance jurisdiction, without excluding the courts specified in Consumer Protection Act Article 47 or Code of Civil Procedure Article 436-9 for small claims.
